The following terms and conditions will apply between you and Pipe Scenes for the purchase of any item. These terms do not affect your statutory rights.

Acceptance of Terms and Conditions

By ordering a product from Pipe Scenes you accept these terms and conditions. These terms and conditions are subject to change at any time.

Orders

The products, descriptions, and prices shown on this website constitute an “invitation to treat”, consequently all orders are subject to acceptance and product availability.

Orders placed through this website, whether payment is made at the time of order or not, are subject to confirmation of acceptance by Pipe Scenes. Up to the point of acceptance orders placed through the online ordering facility should not be interpreted as contractually binding on either party. Automated system acknowledgements of receipt of the order, confirmation of order, or receipt of payment, do not constitute acceptance of the order by Pipe Scenes. Dispatch of your order at the prices shown on the website will in all cases constitute formal acceptance of the order by us in the absence of any other formal acceptance.

Our Contract

A legally binding contract between you and Pipe Scenes will be formed when your order is dispatched. If your order is only partially dispatched, the contract will only apply to the goods dispatched. The products that have not been dispatched will not form part of this contract with you until they are dispatched.

Although Pipe Scenes endeavour to ensure prices on this website are correct, Pipe Scenes reserve the right to change prices without prior notice. In the event of any change e.g. in price or expected delivery date between completion of your order and dispatch, Pipe Scenes shall inform you by e-mail and you shall at that point have the right to either (a) accept the change, in which case your reply will represent a new offer which Pipe Scenes will accept upon dispatch, or (b) reject the change, in which case your reply will represent a withdrawal of your order, or the remaining part of your order.

Product Substitution

In the event of a product becoming unavailable, no alternative product will be substituted by Pipe Scenes without your prior agreement. Pipe Scenes shall inform you by e-mail of any suitable substitute product and you shall at that point have the right to either (a) accept the substitution, in which case your reply will represent a new offer which Pipe Scenes will accept upon dispatch, or (b) reject the change, in which case your reply will represent a withdrawal of your order, or the remaining part of your order.

Delivery Times and Charges

Orders are usually dispatched within 7 to 14 days of receipt of order. If Pipe Scenes do not have the item you have ordered in stock you will be advised of the estimated delivery time.

Orders for delivery to mainland UK are chargeable at the rates shown below, and will be shipped by the most appropriate method selected by Pipe Scenes. Express delivery may be arranged by quotation.

All orders for standard delivery: £10.00 plus VAT

Orders to overseas or non-mainland destinations are by quotation - please email us.

VAT

Prices shown on this site are inclusive of VAT at the prevailing rate.

Payment

Pipe Scenes accept debit or credit cards and cheques made payable to Pipe Scenes.

All orders must be paid for prior to dispatch.

All credit and charge card payments are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Pipe Scenes, your order will not be accepted and Pipe Scenes will not be liable for any delay or non-delivery.

Orders paid for by cheque will not be dispatched until Pipe Scenes receive confirmation of cheque clearance.

Returns Policy

You have certain statutory rights of cancellation and return as detailed below. Any other returns will only be accepted at the sole discretion of Pipe Scenes. Pipe Scenes reserve the right to levy any carriage, handling or restocking charges Pipe Scenes deem appropriate. IMPORTANT: Your attention is drawn to the “Your undertakings and warranties” and our “Limitation of Liability” clauses below.

Notice of Your Statutory Right to Cancel

You have the right to cancel the purchase of any item from the time it is ordered to within seven working days of delivery (starting the day after you receive the goods). This is a UK statutory right.

Should you exercise your statutory right to cancel the contract Pipe Scenes will refund the price you have paid for the goods and standard delivery, but not an additional service provided by Pipe Scenes, such as special packing or a special delivery service.

You are under a duty to take reasonable care of the goods, which means you are responsible for maintaining the goods in the same condition in which they were received. If the item is not in the same condition as delivered, this may affect your statutory right to cancel.

How to cancel

To cancel an order, please send a request to cancel the order in writing, by either e-mail or post, stating the reasons for your cancellation of the order or return.

Please note that you will be responsible for the costs of returning the goods to us unless Pipe Scenes delivered the item to you in error, or the item is faulty. If Pipe Scenes do not receive the goods back from you, Pipe Scenes may arrange for collection of the item from you and charge the cost of collection to you.

After cancellation of the order, Pipe Scenes will refund the relevant part of the purchase price for that item to you as soon as possible after the return of the goods, and within a maximum period of 30 days from cancellation.

Refunds will be made by the same method of payment as the original payment. Pipe Scenes will not be responsible for any delays arising through the banking system in the crediting of refunds to cardholder accounts.

Force majeure

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control.

Your undertakings and warranties

You warrant that the information given on your order form is complete and accurate.

You warrant that you have read all the product brochure and installation information provided on the Pipe Scenes web site, and that prior to ordering you have taken all suitable care, including the gaining of suitably experienced and qualified professional advice where appropriate, as to the suitability of the product for the purpose to which you intend to put it.

Limitation of Liability

Although Pipe Scenes take every care to ensure accuracy, Pipe Scenes make no warranties as to the accuracy of the information on the web site.

THE SERVICE AND THE MATERIALS ARE PROVIDED BY PIPESCENES ON AN "AS IS" BASIS, AND PIPE SCENES EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SERVICE OR ANY MATERIALS AND PRODUCTS. IN NO EVENT SHALL PIPE SCENES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER WITH RESPECT TO THE SERVICE, THE MATERIALS AND THE PRODUCTS.

ALL CONTENTS ON THIS SITE ARE PROTECTED BY COPYRIGHT. EXCEPT AS SPECIFICALLY PERMITTED HEREIN, NO PORTION OF THE INFORMATION ON THIS WEB SITE MAY BE REPRODUCED IN ANY FORM, OR BY ANY MEANS, WITHOUT PRIOR WRITTEN PERMISSION FROM PIPE SCENES. Invalidity of Terms and Condition

If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.

Governing Law and Jurisdiction

Contracts between you and Pipe Scenes shall be governed by English Law and you and Pipe Scenes submit to the exclusive jurisdiction of the English courts.
